Clark County child sex abuse trial delayed

Court officials review legal language; trial expected to begin next week

JEFFERSONVILLE — The trial of a Charlestown woman charged with a slew of sexual child abuse felonies has been delayed a week.

Attorneys found an error in the legal language used in two of the seven felony charges that were issued against Juanita Fisher, 35, of 318 Berkley Drive. Fisher will be tried for alleged sex crimes against children, to whom officials have said she is of relation, that occurred between 2006 and 2011.

Jury selection was slated to begin today, March 6, but after a hearing in Clark County Circuit No. 1 Tuesday afternoon, the trial was rescheduled to Tuesday, March 12.

The body of language which required modification involved two counts of vicarious sexual gratification, both class C felonies. 

Clark County Deputy Prosecutor Linda Lamping is representing the state. She said the error in the legal language and “evidentiary issues, which were complex” convinced Judge Daniel Moore to allow for the continuance requested by the defense.

Fisher will be represented by public defenders Jeff Stonebraker and Mitchele Harlan, who were appointed by the court.
