Animal shelter deal gets official OK

Invoice expected to be sent to Clark County Commissioners

JEFFERSONVILLE — An agreement reached between the Clark County Commissioners and the city of Jeffersonville Friday was officially OK’d by the city Wednesday morning.

Jeffersonville’s Board of Public Works unanimously approved an agreement that would allow Jeffersonville to collect $150,000 in payments to the J.B. Ogle Animal Shelter covering payments owed by the county from 2010 through 2013. Also, the city will not owe for lease of 3,000 square feet of space in the Clark County Government Building from 2010 through 2014.

The city and the county had disagreed over payments that have not been made to the animal shelter operated by Jeffersonville. While the shelter is operated by the city, it collects animals throughout the county and in return, other Clark County municipalities and the county make payments to the shelter based on population. 

The last formal agreement between all parties was signed in 1991, with extensions that carried the agreement through 1999, but since that time the animal shelter has been operating without an agreement. 

From 2010-12, Clark County failed to pay its bill to the animal shelter and argued that the interlocal agreement that did exist should be renegotiated in light of the annexation that absorbed county residents into the city of Jeffersonville. During the same time period, Jeffersonville failed to pay for space its police department had leased for storage in the basement of the Clark County Government Building.

The fight to collect the annual payment of $66,500 from the county and the more than $11,000 per year owed by the city came down to a March 4 deadline that was imposed to reach an agreement, at which point the city said it would stop accepting animals brought from unincorporated areas of the county. A settlement was reached Friday, March 1.

With the agreement in place, negotiations on a new interlocal deal involving all of the area municipalities and the county are planned.

“Hopefully, by Jan. 1, 2014, we’ll have a new agreement in place,” said City Attorney Les Merkley.

He added that by the time a new agreement is reached, the city should no longer require the space that is being leased in the county building.

“Hopefully, by the end of next year, we’ll have a new police headquarters,” he said.

Merkley added that the county has planned to make its payments in two installments and with the approval of the agreement Wednesday, an invoice will be sent to the commissioners.

The agreement still has not received official approval from the Clark County Commissioners, which will hold its next meeting March 14.

 

SIGNS, SIGNS

Signs that will be posted to notify homeless residing in Jeffersonville were presented and approved at the board of public works meeting.

A resolution passed by the board at its last meeting requires the city post a notice 48 hours prior to conducting a sweep of a homeless camp. The notice that will be posted specifies the sweep will take place 48 hours from the date to be filled in by the city and that the property collected during the cleanup will be held for 30 days, with contact information to reclaim the belongings to be provided.

The notice was unanimously approved by the board.

 

SPECIAL EVENTS APPROVAL

A number of applications for special events were approved at the board of public works meeting.

The Feel the Burn 5K at Jeffersonville High School at 9 a.m. April 6; Fido’s 5k run to benefit Southern Indiana Animal Rescue at 9 a.m. May 11; a 5K run to benefit Serenity House at 8 a.m. May 18; and the Senior Games fun walk May 30 were approved.

 

LEASE AND PAVING AGREEMENT OK’D

Three lease agreements to replace Jeffersonville Police Department administration vehicles were approved.

The terms of the leases are four years and at the end of the leases, police have the option to buy the vehicle for $1. The money to pay for the leases will come from federal forfeiture money.

The board of public works also accepted all paving bids opened a the previous meeting, contingent upon the development of a paving plan.

Merkley explained the approval allows Jeffersonville Street Commissioner David Hosea the flexibility to choose the company that has the best price at the time of construction. 

The companies that submitted bids included Louisville Paving Co. Inc., MAC Construction and Excavating Inc., Gohmann Asphalt and Construction Inc. and Hall Contracting.
