Floyd County Prosecutor convenes grand jury

Prosecutors seeks answers NAPD didn’t provide

NEW ALBANY —

A grand jury convened in Floyd County Tuesday, where Floyd County Prosecutor Keith Henderson will attempt to find answers he said New Albany police didn’t provide during its investigation of the deaths of three members of the Clutter family.

“I wasn’t satisfied, ultimately, with the communication I had with the investigators and the final report,” Henderson said. “Plus, it is a difficult case. There are some unanswered questions that I am seeking the answers to.”

Jamie Clutter, 35, and her two children, 10-year-old Brandon Clutter and 6-month-old Katelyn Clutter, were found dead March 13 in a creek in New Albany’s Binford Park.

On April 24, Henderson announced that he would convene the grand jury because of the lack of information provided to his office by the NAPD.

He stated at the time, “I have not received any information from the police department. I have not received a case report from the police department in this case. At this point, after six weeks, we have to move forward, and we are going to do that with the grand jury.”

More than three weeks later, during a press conference, NAPD Chief Sherri Knight said the department concluded that “the deaths of Mrs. Clutter and her children were consistent with drowning.”

She also stated at the time that all toxicology reports were found to be negative.

While authorities had previously confirmed the children had drowned, police had not given specifics on how Jamie Clutter died.

Knight said based on the investigation, “mental illness was the underlying cause of these tragic events,” and that no charges will be filed.

Following the submission of the police’s final report on the investigation to the prosecutor’s office, plans to convene the grand jury remained. 

Henderson said Monday that the grand jury was his only avenue in light of the poor communication between his office and the NAPD.
