NEW ALBANY — A New Albany man is being held in the Floyd County Jail after he allegedly stabbed a family member Tuesday at a residence along Mary Lee Drive.

Cody D. Burns, 18, faces a charge of battery by means of a deadly weapon, a C felony, for the stabbing, which was allegedly provoked by the family member telling Burns to pull up his pants.

According to a probable cause affidavit, after being told to pull up his pants by the relative, Burns walked into the kitchen and returned to the living room with a knife in his hand. The relative said Burns came at him and stabbed him in the left side of his chest, according to the affidavit. Police noticed blood on the floor where the victim was sitting. The injuries to the victim were not life threatening.

Another witness supported the victim’s statement, according to the affidavit.

Burns is currently in the Floyd County Jail. His bond is fixed at $75,000.
