Man charged for attacking girlfriend in public

Police contacted hours later from New Albany restaurant

NEW ALBANY — A man is behind bars following accusations he badly beat his girlfriend in the parking lot of a New Albany Burger King last month.

James M. Boule, 30, whose city of residence wasn’t listed by police, was charged in a Floyd County court Friday with class C felony battery resulting in serious injury, a crime punishable up to eight years in prison.

Boule is claimed to have driven his girlfriend to the Burger King, her place of employment, the morning of Nov. 24. According to the probable-cause affidavit, the couple parked at the restaurant as the woman finished getting ready in the back seat of the vehicle before going inside. The woman claimed Boule became enraged after she told him she was ending their relationship.

“[The woman] informed [Boule] that she was breaking up with him, due to her receiving information and photos of him seeing another woman behind her back,” according to the affidavit.

The woman told police Boule responded by exiting the vehicle and getting in the back seat with her. She claims he then began punching her in the face and head, and while she tried to defend herself, he bit her hand so hard that it began to bleed. She also told police he was using his thumbs to gouge her eyes.

The woman said that she was able to break free, and while attempting to get out of the vehicle, Boule slammed the door on her foot, causing intense pain.

A witness reported that Boule was seen slapping and kicking the woman and prevented her from exiting the vehicle after the couple had arrived to the Burger King.

The woman was later taken to Floyd Memorial Hospital, and police reported her foot had been broken during the incident.

“[She] stated that [Boule] continued to hit and punch her, and that he was holding her in the vehicle and would not let her escape,” according to the affidavit.

The woman was eventually able to get out of the vehicle and inside the Burger King, where she found safety in the restaurant’s office.

According to the affidavit, Boule followed her into the restaurant and screamed and yelled for her to come out.

Another employee reported to police that Boule had told her, “I will beat her like a man.”

The same employee also told police that Boule had sat in the dining area of the restaurant for two hours, waiting for the woman to come out.

“In this entire time, no one called police,” police reported.

Boule’s friend later told police she was “too scared to call anyone.”

The woman finally called a friend to take her to the hospital for treatment of her injuries.

The woman left the back door of the restaurant, and while getting into her friend’s vehicle, Boule began to run after her, she reported to police.

The woman told police she had filed a domestic battery report against Boule with the Harrison County Sheriff’s Office in August. The woman told police that she could not provide an address of Boule because he does not keep a regular address, but sometimes stays at Clarksville motels.

Boule was booked in the Floyd County Jail about 4 a.m. Christmas Day after a warrant had been issued for his arrest Dec. 5.

During his initial hearing Friday, Boule was given a $25,000 court-cash bond.
