CRIME BRIEFS: Man accused of pointing gun; son admits to stealing mom's car

CLARK COUNTY — Firearm pulled outside C’Ville business

Clarksville police responded to La Loma Mexican restaurant on Eastern Boulevard on Sunday, May 18, after receiving a call that a man had pointed a firearm at a female in the establishment’s parking lot.

The caller alerted dispatch while officers were en route that the suspect, later identified as Marlon Alvarez, of 940 E. Maple St. in Jeffersonville, was sitting in a vehicle outside of the restaurant. Responding officers found the vehicle in the parking lot occupied by Alvarez and another person. The officers ordered the two people out of the vehicle, which they complied to without incident.

During a search of the vehicle, police located a black hi-point .40-caliber pistol near the parking brake between the driver and front passenger’s seats.

The 911 caller reported that she fled the area in fear of her life after Alvarez had pointed the pistol at her head and chest. The caller and her husband told police that they were at La Loma when Alvarez pulled behind them and refused to let them back out their vehicle.

“At this point, [Alvarez] exited the vehicle pulling up his shirt showing the pistol,” according to the affidavit. “A few minutes later he drew the pistol from his waistband and pointed it at the two individuals.”

Following the incident, the couple was able to maneuver their vehicle away from the restaurant and fled the scene while calling police. Alvarez did not have a license to drive the vehicle or a permit to carry the pistol.  

He provided a .182 BAC, which is more than two times the legal limit for drivers 21 years old and older, police reported. Police also reported that a field sobriety test was not administered because of a language barrier.

Alvarez has been charged in Clark County Circuit Court No. 4 with two counts C felony intimidation, two counts D felony pointing a firearm, carrying a handgun without a license, a class A misdemeanor, and operating never licensed, a class C misdemeanor.
