Clark County man jailed after admitting to child sex abuse

Abuse of girl, 14, took place during holiday party

CLARK COUNTY — A Clark County man is on home incarceration following claims he sexually abused a 14-year-old girl and an 11-year-old boy in his Nabb home Christmas Day.

Joshua L. Browning, 36, Ind. 362, surrendered to authorities on March 20, after a warrant for his arrest had been issued a week earlier.   

He appeared in Clark County Circuit Court No. 1 with attorney Carlo Coleman and entered a not guilty plea to a class C felony charge of sexual misconduct and two class D felony charges of sexual battery.

According to Browning’s comments Dec. 30 to a Clark County Sheriff’s investigator, after drinking a half gallon of Jim Beam bourbon on Christmas Day, he put his hands in the backside of the girl’s pants while the two were in the basement of his home.

The sexual battery charges stem from claims that Browning patted the two children’s backsides while in the basement during the holiday function.

According to a probable cause affidavit, the sheriff’s office was first notified of the alleged sexual abuse late Christmas Day. Responding deputies were told by the children’s mother that while driving home from the party, her daughter claimed Browning inappropriately touched her while at his home earlier in the day.

The girl told the deputy that Browning had asked her to come to the basement with him. After entering the basement, the girl claims Browning told her to sit on his lap, which made her feel uncomfortable because he had never made such a request.

“[The child] stated while sitting in Browning’s lap, he began rubbing her upper thigh area continuously, which [the child] advised made her feel extremely uncomfortable,” according to the report. “She stated she attempted to lean the opposite direction as if to get away from Browning[’s] hand, at which point he would put his hand ... underneath her buttocks in attempt to feel it.”

The girl reported Browning also kissed her and her brother on the cheek and forehead, but did not touch her anywhere else inappropriately.

She then stated while the children were walking up the stairs, Browning gave them each a “pat” on their backsides.

After joining the others at the party, the girl reported that Browning again approached her and asked her to join him in his bedroom, which she did.

“While in the bedroom, [the child] stated Browning began rubbing her back,” according to the affidavit. “She also stated Browning kept asking her to turn around and began complementing her on her hair.”

Feeling uncomfortable, the child left the bedroom and a short time later left the home with her brother and mother.

After speaking with the girl and her mother, deputies went to locate Browning at his home, but no one responded to the front door.

Five days later, on Dec. 30, Browning came to the Clark County Sheriff’s Office to speak with investigators. He said at the time that he had begun drinking heavily earlier in the year after his wife’s complicated pregnancy.

Browning said on Christmas Day he had drank a half gallon of bourbon in his garage about 5 p.m. and that he vaguely remembers going into the home, but couldn’t recall anything else until 5 a.m. the following morning.

“Mr. Browning advised that he did pat [the child] on her butt,” according to the report.

According to court records, a pretrial conference is scheduled in May, and a trial date has been set July 15.
