Police: Man severely beaten, cut in New Albany robbery

Suspect allegedly stole pain pills

NEW ALBANY — After he was beaten with a sledgehammer and stabbed, police say a New Albany man was robbed of his pain pills that he needed for a previous injury early Friday morning.

Jeremy J. Cervantes, 41, New Albany, was arrested after the alleged victim identified him in a photo lineup from his hospital bed.

According to a probable-cause affidavit, the man recognized Cervantes as an old friend while he was at Hugh E. Bir’s in New Albany. They later went to the Rustic Frog and Boot Scoot before returning to the man’s home.

The man told Cervantes he was going to take a pain pill for his broken arm, and Cervantes asked for some of the pills, according to the affidavit. After refusing, the affidavit says Cervantes grabbed a filet knife and slashed at him, causing deep lacerations to his face and arms. He also reportedly took a 10-pound sledgehammer and beat the victim, causing a skull fracture.

After responding to a call from the man’s neighbor, they found him sitting in a chair in front of his home on Village Drive, bleeding and battered. Officers reported “a large amount of blood” in several places in the home.

In an initial photo lineup, the victim didn’t pick Cervantes out of the group. Detectives got verification on a photo of Cervantes, which they showed to the man after he was transported to University of Louisville Hospital.  The man confirmed through another photo lineup that Cervantes was the man who beat and cut him.

Cervantes is incarcerated at the Floyd County Jail and under a $200,000 bond. He faces charges of robbery resulting in serious bodily injury, a class A felony, and battery committed by means of a deadly weapon or resulting in serious bodily injury, a class C felony.

Cervantes’ jury trial is scheduled for 9 a.m. Jan. 27 in Floyd County Superior Court No. 1.
